Deeditt grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Deeditt software ("Software") strictly in accordance with the terms of this EULA. This license covers the software and any updates, upgrades, or documentation provided in connection with the Software.
You retain full ownership and rights to the intellectual property and content you create and upload through the Software. By providing such content, you grant Deeditt a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display the content solely for the purpose of providing and enhancing the Software Services. This license remains in effect until either you or Deeditt remove the content from the Software.
You have the right to terminate this EULA at any time by discontinuing use of the Software and deleting all copies. Deeditt reserves the right to terminate this EULA and your license to use the Software if you fail to comply with any term or condition herein. Upon termination, you must cease all use of the Software and delete all copies of the Software.
Deeditt provides the Software "as is" and "as available" without any warranty of any kind, either express or implied. We do not make any representations or warranties regarding the reliability, accuracy, completeness, or fitness for a particular purpose of the Software.
To the fullest extent permitted by applicable law, all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, are expressly disclaimed.
Deeditt's liability is limited to the maximum extent permitted by law. In no event shall Deeditt be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use or inability to use the Software.
Some jurisdictions may not allow certain disclaimers or limitations of liability, so some of the above disclaimers and limitations may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by law in your jurisdiction.
To the extent not prohibited by law, in no event shall Deeditt be liable for personal injury, or any incidental, special, indirect, or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use or inability to use the Software, however caused.
This EULA shall be governed by and construed in accordance with the laws of the European Union. This choice of law is made to facilitate the resolution of any potential disputes within the European Union, where Deeditt's infrastructure is hosted.
Any disputes arising out of or in connection with this EULA shall be resolved through binding arbitration within the European Union, under the rules of an applicable arbitration association, and any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
If any provision of this EULA is illegal or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that this EULA will otherwise remain in full force and effect and enforceable.
